ACCEPTANCE OF THESE TERMS

By accessing, purchasing, subscribing to, downloading, registering for,
or otherwise using the Frolic & Forage Society or any of its websites,
memberships, products, services, digital resources, community spaces, or
events (collectively, the “Services”), you acknowledge that you have
read, understood, and agree to be bound by these Terms and any policies
incorporated by reference.

If you do not agree to these Terms, you may not access or use the
Services.

SECTION 1. INDEPENDENT STATUS

The Frolic & Forage Society is a brand of Designed to Thrive Creative,
LLC that operates as a creative community. Except where expressly
authorized in writing by Designed to Thrive Creative, LLC, all members,
participants, organizers, and hosts act solely on their own behalf.

Nothing in these Terms creates an employment, agency, partnership, joint
venture, franchise, affiliate, representative, or other legal
relationship between you and Designed to Thrive Creative, LLC. You have
no authority to act for, bind, or incur obligations on behalf of
Designed to Thrive Creative, LLC, or to represent that you are
authorized to do so.

SECTION 2: INDEPENDENT TROOPS & GATHERINGS

For purposes of these Terms, a “troop” is an independently organized
gathering of participants who choose to use Frolic & Forage Society
resources together. The term “troop” is a community descriptor only
and does not create or imply an official chapter, affiliate, franchise,
agency, partnership, or representative relationship with Designed to
Thrive Creative, LLC.

Unless expressly designated by Designed to Thrive Creative, LLC as an Official Frolic & Forage Society Event, all troops, gatherings, meetings, craft circles, virtual or hybrid gatherings, social media groups, group chats, video calls, and other in-person or online activities are independently organized by participants.

Designed to Thrive Creative, LLC does not organize, sponsor, host, administer, supervise, moderate, monitor, control, insure, or assume responsibility for independently organized troops, gatherings, or online spaces. Individuals who organize or participate in them do so voluntarily and at their own risk.

From time to time, Designed to Thrive Creative, LLC may organize or
sponsor Official Frolic & Forage Society Events. Such events will be
clearly identified as official and may be subject to separate terms,
registrations, waivers, or participation requirements.

Continued Use of Society Names & Materials

Independent local troops are welcome to gather using the spirit and many of the resources of the Frolic & Forage Society, provided they comply with these Terms & Conditions, our Community Guidelines, and our Brand Use Policy.

Permission to use the Frolic & Forage Society name, trademarks, logos, artwork, badge designs, printables, and other Society materials is limited, non-exclusive, revocable, and does not create any official affiliation, agency, franchise, chapter, or representative relationship with Designed to Thrive Creative, LLC.

We reserve the right, in our sole discretion, to withdraw permission to use Society names, branding, resources, or other intellectual property, and to remove a troop from our directory or other Society listings, if we reasonably believe a troop:

• Misrepresents itself as an official chapter, affiliate, representative, or agent of the Frolic & Forage Society or Designed to Thrive Creative, LLC.

• Creates an unsafe, abusive, discriminatory, or exploitative environment.

• Violates these Terms & Conditions, our Community Guidelines, or our Brand Use Policy.

• Infringes upon our intellectual property rights.

• Uses Society names, branding, or materials in a manner that is misleading or materially inconsistent with the stated purpose of the Frolic & Forage Society, our Community Guidelines, or our Brand Use Policy.

Withdrawal of permission to use Society names, branding, or materials does not prohibit individuals from continuing to gather independently. It simply means the gathering may no longer identify itself as, or use the intellectual property of, the Frolic & Forage Society.

SECTION 3. ASSUMPTION OF RISK, NO PROFESSIONAL ADVICE & LIMITATION OF LIABILITY

Your use of the Frolic & Forage Society, including its website,
membership, digital resources, printables, Field Guides, Gathering
Guides, celebration badges, podcasts, community spaces, official events,
and independently organized troops or gatherings, is voluntary and at
your own risk.

All content and resources provided by the Frolic & Forage Society are
offered for educational, informational, recreational, and creative
purposes only. Nothing provided by Designed to Thrive Creative, LLC or
the Frolic & Forage Society constitutes medical, mental health,
psychological, legal, financial, tax, nutritional, or other professional
advice. You are solely responsible for your own decisions and for
obtaining professional advice appropriate to your individual
circumstances.

You are solely responsible for how you choose to use the Frolic & Forage
Society’s resources and for any activities, gatherings, projects,
crafts, discussions, or decisions arising from their use. Designed to
Thrive Creative, LLC does not direct, supervise, or control how
participants implement, adapt, or apply Society resources. This includes
any modifications, adaptations, combinations, or alternative uses you
make of Society resources or activities.

You are responsible for exercising reasonable judgment and taking
appropriate safety precautions based on your own abilities, experience,
environment, and circumstances.

To the fullest extent permitted by applicable law, Designed to Thrive
Creative, LLC; the Frolic & Forage Society; D. Michele Perry; and their
respective owners, officers, directors, employees, contractors,
licensors, affiliates, successors, and assigns (collectively, the
“Released Parties“) shall not be liable for any direct, indirect,
incidental, consequential, special, exemplary, or punitive damages, or
for any injury, illness, death, property damage, financial loss,
emotional distress, or other loss, claim, liability, cost, or expense
arising out of or relating to:

• your access to or use of the Frolic & Forage Society or its
  resources;

• your reliance on, implementation of, or participation in any
  activities, crafts, projects, discussions, Field Guides, Gathering
  Guides, or other Society resources;

• your participation in any official event or any independently
  organized troop, gathering, meetup, or activity; or

• independently organized virtual gatherings, social media groups, messaging groups, video calls, online communities, or other digital spaces, including conduct, communications, content, transactions, privacy or security incidents, disputes, harassment, misrepresentation, or other interactions occurring within or arising from those spaces;

• the acts, omissions, or conduct of any participant, organizer, host,
  venue, vendor, or other third party.

Nothing in these Terms excludes or limits liability where such exclusion
or limitation is prohibited by applicable law.

Certain official events may require separate registrations, waivers,
releases, or participation agreements, which will supplement these
Terms.

SECTION 4. COMMERCIAL ACTIVITIES

Except where expressly authorized in writing by Designed to Thrive
Creative, LLC, you may not act as a representative, reseller,
distributor, franchisee, licensee, or commercial agent of Designed to
Thrive Creative, LLC or the Frolic & Forage Society.

You may not solicit orders, collect payments on behalf of the company,
enter into contracts, or otherwise conduct business in the name of
Designed to Thrive Creative, LLC or the Frolic & Forage Society. You may
not represent that you are authorized to sell, license, distribute, or
promote the company’s products, memberships, services, or digital
resources.

Nothing in this Section prohibits participants from voluntarily sharing
or collecting reasonable amounts to reimburse the actual costs of
independently organized gatherings, such as venue rental, refreshments,
craft supplies, or similar incidental expenses, provided that no person
is acting on behalf of Designed to Thrive Creative, LLC or profiting
from the sale or distribution of the company’s products or resources.

Unless expressly authorized in writing by Designed to Thrive Creative,
LLC, you may not reproduce, redistribute, sell, or commercially exploit
Frolic & Forage Society materials, merchandise, or digital resources
beyond the rights granted by their applicable license or these Terms.

SECTION 5. BRAND USE & INTELLECTUAL PROPERTY

The Frolic & Forage Society name, logos, artwork, celebration badges, designs, and other brand elements (collectively, the “Brand Assets”) are owned by Designed to Thrive Creative, LLC and are protected by applicable trademark, copyright, and other intellectual property laws.

You may refer to the Frolic & Forage Society solely to describe that your independent troop or gathering uses its resources, provided you do not imply that your troop or gathering is officially sponsored, endorsed, affiliated with, operated by, or otherwise authorized by Designed to Thrive Creative, LLC.

You may not represent or imply that your independent troop or gathering is an official chapter, affiliate, franchise, agency, representative, or other authorized branch of the Frolic & Forage Society or Designed to Thrive Creative, LLC unless expressly authorized in writing by Designed to Thrive Creative, LLC.

You may not use the Brand Assets in a manner that is likely to cause confusion regarding the source, sponsorship, affiliation, or endorsement of your troop, gathering, organization, products, services, or activities.

You may not register business names, legal entities, domain names, trademarks, or similar legal or commercial identifiers incorporating or confusingly similar to the Brand Assets without the prior written consent of Designed to Thrive Creative, LLC.

Independent troops may create social media accounts, groups, pages, or other online communities that identify their connection to the Frolic & Forage Society, provided the name, handle, profile, and presentation clearly identify the account as belonging to an independent troop and do not create a likelihood of confusion with an official Frolic & Forage Society account.

Independent troops may not use names, handles, or other social media identifiers that imply they are an official, regional, or authorized account or representative of the Frolic & Forage Society or Designed to Thrive Creative, LLC.

Any social media account, group, page, online community, directory listing, or other public presence created for an independent troop must clearly indicate that it is independently organized and is not an official Frolic & Forage Society organization. When reasonably possible, independent troop accounts and groups should include the statement “An independent Frolic & Forage Society troop” in their profile or description.

Continued Permission

Nothing in these Terms & Conditions grants any permanent or irrevocable right to use the Frolic & Forage Society name, trademarks, logos, artwork, badge designs, printables, or other intellectual property. Any permission granted under these Terms, our Community Guidelines, or our Brand Use Policy may be modified or withdrawn at any time.

SECTION 6. COMPLIANCE WITH APPLICABLE LAWS

Independent troop organizers and participants are solely responsible for
ensuring that their gatherings comply with all applicable laws,
regulations, ordinances, permits, venue requirements, and safety
requirements in the jurisdictions where their activities take place.

Organizers of virtual gatherings or online spaces are also solely responsible for their choice and use of third-party platforms and for compliance with applicable laws, platform terms, privacy requirements, and other requirements relating to their online activities.

Designed to Thrive Creative, LLC does not organize, supervise, inspect,
or verify independent troops, gatherings, venues, or activities for
legal compliance or safety. Responsibility for selecting an appropriate
venue, obtaining any necessary permissions or permits, maintaining
appropriate insurance (if desired or required), and complying with
applicable laws rests solely with the independent organizers and
participants.

Nothing in the Frolic & Forage Society or its resources should be
interpreted as legal, regulatory, or safety guidance regarding the
planning or operation of independent gatherings.

SECTION 7. COMMUNITY DIRECTORY & INDEPENDENT GATHERINGS

From time to time, Designed to Thrive Creative, LLC may provide a
directory, calendar, map, or other means of helping participants connect
with independently organized troops and gatherings.

Any listing is provided solely as a convenience to help participants
find one another. Inclusion in a directory or other community resource
does not constitute an endorsement, sponsorship, approval, verification,
or official designation by Designed to Thrive Creative, LLC or the
Frolic & Forage Society.

Communications between participants, whether through the Society
website, Substack, social media, email, messaging platforms, or any
other means, do not create or imply an official relationship, agency,
sponsorship, or affiliation between participants and Designed to Thrive
Creative, LLC or the Frolic & Forage Society.

Designed to Thrive Creative, LLC does not verify the identity of
organizers, the safety or suitability of venues, the accuracy of
listings, or the legality or quality of independently organized troops
or gatherings. Participants are solely responsible for exercising their
own judgment when choosing whether to organize, attend, or participate
in any independently organized gathering.

Nothing in this Section limits Designed to Thrive Creative, LLC’s right
to remove, decline, or edit any directory listing or community resource
at its sole discretion.

SECTION 8. DIGITAL RESOURCES & PERSONAL USE LICENSE

Unless otherwise expressly stated, all Frolic & Forage Society
resources, including digital downloads, printables, templates, Field
Guides, Gathering Guides, celebration badges, artwork, patterns,
designs, audio, video, and other content (collectively, the
“Resources“) are licensed, not sold.

Subject to your compliance with these Terms, Designed to Thrive
Creative, LLC grants you a limited, non-exclusive, non-transferable,
revocable license to download, print, and use the Resources for your
personal, non-commercial use and for participation in independently
organized Frolic & Forage Society troops or gatherings.

Except as expressly permitted by these Terms or by written authorization
from Designed to Thrive Creative, LLC, you may not:

• reproduce, redistribute, or publicly share the Resources;

• sell, sublicense, rent, lease, or otherwise commercially exploit the
  Resources;

• upload, post, share, distribute, or otherwise make the Resources
  available to others;

• modify the Resources for commercial distribution or create products
  derived from them for sale; or

• manufacture or sell products incorporating the Society’s artwork,
  badge designs, patterns, or other protected content.

You may print or reproduce reasonable quantities of Resources for use
within your own independent troop or gathering, provided such copies are
not sold, publicly distributed, or used for commercial purposes.

All rights not expressly granted remain the exclusive property of
Designed to Thrive Creative, LLC.

SECTION 9. OFFICIAL EVENTS

From time to time, Designed to Thrive Creative, LLC may organize or
sponsor Official Frolic & Forage Society Events (”Official Events“).

An event is considered an Official Event only if it is expressly
identified as such by Designed to Thrive Creative, LLC through its
official website, official communications, or event registration
materials.

Official Events may be subject to additional terms, registrations,
waivers, codes of conduct, ticketing agreements, or other participation
requirements, which are incorporated into these Terms by reference.

Unless expressly designated as an Official Event by Designed to Thrive
Creative, LLC, all troops, gatherings, meetups, craft circles, and other
activities are deemed Independent Gatherings and remain subject to the
provisions of these Terms governing Independent Gatherings.

SECTION 10. CREATIVE FRAMEWORK & FICTIONAL ELEMENTS

The Frolic & Forage Society is a brand of Designed to Thrive Creative,
LLC that uses an imaginative, story-inspired framework to encourage
creativity, curiosity, community, and play. Certain aspects of the
Society, including its lore, traditions, titles, troop concepts, badges,
ceremonies, Field Guides, Gathering Guides, and other world-building
elements, are presented as part of this creative experience.

These creative elements are intended to foster imagination and community
and should not be interpreted as statements of historical fact, legal
authority, professional certification, or official governmental or
nonprofit status.

SECTION 11. ELIGIBILITY & ACCOUNT RESPONSIBILITY

The Frolic & Forage Society is an adult community intended for
individuals 18 years of age or older. By accessing or using the
Society, you represent and warrant that you are at least 18 years old
and have the legal capacity to enter into these Terms and comply with
all applicable laws.

If you create an account or membership, you are responsible for
maintaining the confidentiality of your login credentials and for all
activities that occur under your account. You agree to provide accurate,
current, and complete information and to promptly update it if it
changes.

You agree not to access the Society through fraudulent means,
impersonate another person or organization, or use another person’s
account without permission.

Designed to Thrive Creative, LLC reserves the right to suspend or
terminate your access to the Society if we reasonably believe you have
violated these Terms or that your continued participation poses a risk
to the Society, its members, or the broader community.

SECTION 12. MEMBERSHIPS, BILLING, STORE PURCHASES & REFUNDS

The Frolic & Forage Society may offer free memberships, paid
memberships, digital resources, physical merchandise, event
registrations, and other products or services through Substack, our
website, third-party platforms, or other authorized sales channels.

Memberships, purchases, subscriptions, and payments may be processed by
third-party providers, including but not limited to Substack, Stripe,
Shopify, PayPal, or other payment processors. Your use of those services
is also subject to their applicable terms, conditions, and privacy
policies.

Paid memberships provide access to the benefits described at the time of
purchase. Membership benefits, products, and services may evolve over
time as the Society grows.

Paid memberships automatically renew at the billing interval selected at
the time of purchase unless canceled before the next renewal date. By
purchasing a recurring membership, you authorize the applicable payment
processor to charge your selected payment method until your membership
is canceled.

You may cancel a recurring membership at any time. Unless otherwise required by applicable law, cancellations take effect at the end of the current billing period, and no partial or prorated refunds will be provided for unused time.

You are responsible for canceling your recurring membership before your next billing date if you do not wish to renew. Failure to cancel before renewal does not, by itself, entitle you to a refund or justify a payment dispute or chargeback.

Initiating a payment dispute or chargeback without first contacting us to resolve a billing concern may result in the suspension or termination of your membership, access to digital resources, or future purchasing privileges, to the extent permitted by applicable law.

Unless otherwise stated at the time of purchase or required by
applicable law, all sales of digital products, downloadable resources,
memberships, and event registrations are final. Physical merchandise is
subject to the return or exchange policy posted on our website at the
time of purchase.

Designed to Thrive Creative, LLC reserves the right to modify, suspend,
discontinue, replace, or update membership offerings, pricing, benefits,
products, services, or features at any time. Any such changes will apply
prospectively and will not affect purchases already completed unless
otherwise permitted by law or expressly stated at the time of the
change.

If a payment cannot be successfully processed, Designed to Thrive
Creative, LLC may suspend or terminate access to paid memberships,
digital resources, or other purchased services until the payment issue
is resolved.

SECTION 13. DISCLAIMER OF WARRANTIES

The Frolic & Forage Society, including its website, memberships,
community spaces, digital resources, printables, merchandise, Field
Guides, Gathering Guides, podcasts, events, directories, and all related
content and services (collectively, the “Services“) are provided on
an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, Designed to Thrive
Creative, LLC disclaims all warranties of any kind, whether express,
implied, statutory, or otherwise, including but not limited to
warranties of merchantability, fitness for a particular purpose, title,
non-infringement, accuracy, completeness, reliability, availability,
uninterrupted access, security, or freedom from errors or harmful
components.

Designed to Thrive Creative, LLC does not warrant that the Services will
meet your expectations or requirements, that any content will be
accurate or complete, that access will be uninterrupted or error-free,
or that any defects will be corrected.

Nothing in this Section excludes warranties that cannot be excluded
under applicable law.

SECTION 14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Released Parties
shall not be liable for any indirect, incidental, consequential,
special, exemplary, punitive, or similar damages arising out of or
relating to your use of the Frolic & Forage Society, regardless of the
legal theory asserted.

Without limiting the foregoing, the Released Parties shall not be liable
for lost profits, lost revenue, lost data, business interruption, loss
of goodwill, emotional distress, reputational harm, or any other
indirect or consequential damages arising from or related to the
Services.

To the fullest extent permitted by applicable law, the total cumulative
liability of the Released Parties arising out of or relating to these
Terms or the Services shall not exceed the greater of:

(a) the total amount paid by you to Designed to Thrive Creative, LLC
during the twelve (12) months immediately preceding the event giving
rise to the claim; or

(b) one hundred U.S. dollars (US $100), if no payments were made during
that period.

Nothing in these Terms excludes or limits liability where such exclusion
or limitation is prohibited by applicable law.

SECTION 15. COMMUNITY STANDARDS & MODERATION

The Frolic & Forage Society exists to cultivate a welcoming, respectful,
and encouraging community where creativity, curiosity, kindness, and
mutual respect can flourish. By participating in the Society, you agree
to contribute in a manner that supports these values.

You agree not to use the Society or its community spaces to:

• harass, threaten, intimidate, or abuse others;

• discriminate against or target others based on protected
  characteristics;

• post unlawful, defamatory, fraudulent, or knowingly false content;

• infringe another person’s intellectual property or privacy rights;

• distribute spam, malware, or unsolicited commercial promotions;

• impersonate another individual or organization or misrepresent your
  affiliation with the Society;

• disrupt the operation of the Society or interfere with another
  person’s participation; or

• engage in any activity that Designed to Thrive Creative, LLC
  reasonably determines is harmful to the Society, its members, or its
  community.

The Frolic & Forage Society is intended to be a community centered on
creativity, curiosity, generosity, and connection. Designed to Thrive
Creative, LLC may remove content or restrict participation that is
inconsistent with the spirit, purpose, or well-being of the Society,
even if such content would otherwise be lawful.

Designed to Thrive Creative, LLC reserves the right, but not the
obligation, to monitor community spaces, moderate content, remove posts
or comments, edit or remove directory listings, suspend or terminate
memberships, restrict access to community features, or take any other
action reasonably necessary to protect the Society and its members.

Moderation decisions are made at the sole discretion of Designed to
Thrive Creative, LLC and may be taken with or without prior notice.

Nothing in these Terms obligates Designed to Thrive Creative, LLC to
monitor user content or investigate every reported concern.

SECTION 16. USER CONTENT & LICENSE

You retain ownership of any photographs, artwork, written content,
comments, videos, designs, or other materials (”User Content“) that
you submit, post, upload, or otherwise share through the Frolic & Forage
Society.

Except for the rights expressly granted in this Section, no ownership
rights are transferred to Designed to Thrive Creative, LLC.

By submitting User Content, you grant Designed to Thrive Creative, LLC a
non-exclusive, worldwide, royalty-free, transferable, sublicensable
license to use, reproduce, display, publish, distribute, adapt, modify,
translate, and create derivative works from your User Content for the
purpose of operating, promoting, improving, documenting, and growing the
Frolic & Forage Society and its related brands, publications, products,
services, and marketing.

You represent and warrant that you own or otherwise have the necessary
rights to submit your User Content and to grant the license described in
this Section. You further represent that your User Content does not
infringe the intellectual property, privacy, publicity, or other rights
of any third party.

You are solely responsible for the User Content you submit and for any
consequences arising from its publication or use.

Designed to Thrive Creative, LLC is under no obligation to publish,
maintain, or retain any User Content and reserves the right to remove or
refuse any User Content at its sole discretion.

Designed to Thrive Creative, LLC loves celebrating the creativity of its
community. By sharing User Content with the Society, you acknowledge
that Designed to Thrive Creative, LLC may feature your User Content,
including your first name, independent troop name, and general location
(if you choose to provide them), in newsletters, podcasts, social media,
community galleries, promotional materials, and other Society
publications. If you prefer not to have your User Content featured in
this way, you may notify Designed to Thrive Creative, LLC, and we will
make reasonable efforts to honor your request for future uses.

SECTION 17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Designed to Thrive
Creative, LLC; the Frolic & Forage Society; Michele Perry; and their
respective owners, officers, directors, employees, contractors,
licensors, affiliates, successors, and assigns (collectively, the
“Indemnified Parties“) from and against any and all claims, demands,
actions, liabilities, damages, judgments, settlements, losses, costs,
and expenses (including reasonable attorneys’ fees) arising out of or
relating to:

• your use of the Frolic & Forage Society or its Services;

• your organization of or participation in any independent troop,
  gathering, meetup, event, or activity;

• your creation, administration, moderation, organization of, or participation in any independent virtual gathering, social media group, online community, group chat, video call, or other digital space or activity;

• your User Content;

• your violation of these Terms;

• your violation of any applicable law or regulation; or

• your infringement or alleged infringement of the rights of any third
  party.

Designed to Thrive Creative, LLC reserves the right, at its own expense,
to assume the exclusive defense and control of any matter otherwise
subject to indemnification by you. In such event, you agree to cooperate
fully in the defense of that matter.

SECTION 18. GOVERNING LAW & VENUE

These Terms and any dispute arising out of or relating to the Frolic &
Forage Society, its Services, or these Terms shall be governed by and
construed in accordance with the laws of the State of Florida, without
regard to its conflict of laws principles.

Except where prohibited by applicable law, you agree that any legal
action or proceeding arising out of or relating to these Terms or the
Services shall be brought exclusively in the state or federal courts
located in Duval County, Florida, and you consent to the personal
jurisdiction and venue of those courts.

If you reside outside the United States, you acknowledge that you are
responsible for complying with the laws applicable in your own
jurisdiction when using the Services.

SECTION 19. CHANGES TO THESE TERMS

Designed to Thrive Creative, LLC may revise or update these Terms from
time to time to reflect changes in the Frolic & Forage Society,
applicable laws, or our business practices.

When material changes are made, we will make reasonable efforts to
notify members through the Society, our website, email, or other
official communication channels.

Your continued access to or use of the Society after revised Terms
become effective constitutes your acceptance of those revised Terms.

SECTION 20. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid,
or unenforceable, that provision shall be enforced to the maximum extent
permitted by applicable law, and the remaining provisions shall remain
in full force and effect.

Any unenforceable provision shall be deemed modified only to the extent
necessary to make it enforceable while preserving its original intent
whenever possible.

SECTION 21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return & Refund Policy,
Brand Use Policy, Community Guidelines, and any other policies or
agreements expressly incorporated by reference, constitute the entire
agreement between you and Designed to Thrive Creative, LLC regarding
your use of the Frolic & Forage Society.

These Terms supersede all prior or contemporaneous communications,
understandings, or agreements relating to the subject matter addressed
herein.

No waiver of any provision of these Terms shall be deemed a continuing
waiver of that provision or any other provision unless expressly made in
